Ecosystem Enhancement Program (EEP) may deny future mitigation requests
The EEP has been requesting that fees for wetland and stream mitigation requests for their in-lieu fee (ILF) program be increased significantly to match their cost for providing the mitigation. To this point, these requests have not been approved. As a result, EEP may not accept mitigation requests through the ILF program in several areas of the state. As a result, developers may be required to either complete project-specific stream and/or wetland mitigation projects, or purchase stream and/or wetland credits from a private mitigation banker with credits available in the area the disturbance is to take place.
